Terms, Privacy and Disclosures
SmileWP is a brand of T28X LLC, a Wyoming limited liability company (“SmileWP,” “we,” “us”). By using smilewp.com or buying our services, you agree to these terms.
1. Who we serve
We serve businesses based in the United States only, under United States law only. We do not accept work for sites that collect, store or transmit protected health information. SmileWP does not move online stores.
2. Affiliate disclosure
We are a Kinsta affiliate. When you open a Kinsta account through our link, we may earn a commission at no extra cost to you. We require Kinsta because we run every site on it, not because of the commission. Cloudflare is required too, and we earn nothing from it.
3. Quotes and payment
- Every migration is quoted in writing before work starts. Work outside the written quote is quoted separately.
- Payments are processed by Stripe. We never see or store your full card number.
- Migration fees are paid before work starts. Monthly plans are billed in advance each month.
- You may cancel a monthly plan at any time before your next billing date. We do not refund partial months.
4. Access and timelines
Work starts only after we confirm working access to your Cloudflare account, your current host and any other system named in your quote. Any timeline in your quote starts at that moment. Delays in access, content or approvals on your side extend the timeline by the same amount.
5. Platform requirement
Every site we migrate or manage runs on Cloudflare, Kinsta and the Kadence theme. Sites that cannot meet this requirement are outside our service.
6. What a migration includes
- We move the content, pages and media listed in your quote and redirect old URLs to their new locations.
- Features of your old platform that have no WordPress equivalent are rebuilt only if your quote says so.
- You are responsible for canceling your old platform and hosting, and for keeping your own copy of your old site until you approve the new one.
- Search rankings depend on factors we do not control. We do not guarantee rankings or traffic.
7. Your content
You own your content and confirm you have the right to use everything you give us. Your site’s content stays yours if you leave.
8. Warranty disclaimer
Our website and services are provided as is and as available. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation of any site, host or third-party service.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential losses, including lost profits, data or business. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.
10. Indemnity
You agree to hold us harmless from claims arising from your content, your business or your breach of these terms.
11. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Texas.
12. Changes, severance and waiver
We may update these terms by posting a new version on this page. If any part is found unenforceable, the rest stays in effect. Not enforcing a term once does not waive it.

How we use it
To answer you, quote and deliver our services, bill you, measure and improve our website and ads, and send service messages. Marketing emails include an unsubscribe link.
What we share
We do not sell your personal information. We share it only with the providers that help us run our business, such as hosting, scheduling, payment and analytics providers, or when the law requires it.
Your choices
You can ask to see, correct or delete the personal information we hold about you through our contact form. You can block or delete cookies in your browser.
Children
Our website and services are for businesses and are not directed to anyone under 18.
